Após reconhecimento da eficácia plena e aplicabilidade imediata da norma constitucional pelo Tribunal Superior Eleitoral, coube à jurisprudência dos Tribunais Eleitorais buscarem no ordenamento jurídico o rito processual que deveria ser observado na interposição e processamento da AIME. Num primeiro momento o Tribunal Superior Eleitoral estabeleceu que fosse aplicável à Ação de Impugnação de Mandato Eletivo o rito ordinário do Código de Processo Civil.

After the Tribunal Superior Eleitoral had recognized the absolute efficiency and immediate applicability of the rule, it fell to the jurisprudence of the Tribunais Eleitorais to look for a legal procedure in the law that should be observed in the interposition and processing of the AIME.
