Hiervon abweichend erfolgt der Verkauf von Nutzfahrzeugen enter Ausschluss jeglicher Sachmangelhaftung, wenn der Kaufer eine juristische Person des offentlichen Rechts, ein offentlich-rechtliches Sondervermogen oder ein Unternehmer ist, der bei Abschluss des Vertrages in Ausubung seiner gewerblichen oder selbststandigen beruflichen Tatigkeit handelt. Bei arglistigem Verschweigen von Mangeln oder der Ubernahme einer Garantie fur die Beschaffenheit bleiben weitergehende Anspruche unberiahrt.
