O presente estudo tem por objetivo demonstrar a necessidade da reestruturação da matéria do dano moral no Brasil, concebendo a sua importância como um Direito Fundamental. Ademais, evidencia-se a aplicação do chamado dano punitivo no ordenamento jurídico pátrio, como forma de desestimular a prática de atos ofensivos a Dignidade do homem.

About the last sentence Lein, it's not lacking a verb. Actually it means:
"...as a way to discourage the practice of acts (that are) offensive to Human Dignity."

Ah - in that case, 'it is clear' doesn't work.

It is clear [a subject]. - this needs a verb
[A subject] is clear.

How about this?

I admit the original sentence has a confusing syntax as this kind of extracts usually have. Perhaps we should, indeed, change it to sound more natural in English.
